These Hihru Terms and Conditions of Use (these “Terms and Conditions“) set forth the terms and conditions for the use of any and all products and services (collectively, the “Services”) provided by Hihru Corporation (“Hihru“) to users of the Services (the “User“ or “Users“, depending upon the context).
1.Definitions
The following words and terms shall have the meanings set forth below when they are used in these Terms and Conditions.
1.1.“Contents” means information such as text, sounds, music, images, videos, software, programs, computer code, and other information.
1.2.“Subject Contents” means Contents that may be accessed through the Services.
1.3.“Submitted Contents” means Contents that Users have submitted, transmitted or uploaded on or to the Services.
1.4.“Separate Terms and Conditions” means terms and conditions separate from these Terms and Conditions that pertain to the Services released or uploaded by Hihru under names such as “terms,” “guidelines,” “policies,” or the like.
2.Agreement to these Terms and Conditions
2.1.All Users shall use the Services in accordance with these Terms and Conditions. Users may not use the Services unless they agree to these Terms and Conditions.
2.2.Users who are minors may only use the Services by obtaining prior consent from their parents or legal guardians. Furthermore, if Users will be using the Services on behalf of, or for the purposes of, a business enterprise, then such business enterprise must also agree to these Terms and Conditions prior to using the Services.
2.3.If there are Separate Terms and Conditions applicable to the Services, Users shall also comply with such Separate Terms and Conditions as well as these Terms and Conditions in using the Services.
3.Modification to these Terms and Conditions
Hihru may modify these Terms and Conditions when Hihru deems it to be necessary, within the scope of the purposes of the Services. In such case, Hihru will indicate the contents of the modified version of these Terms and Conditions, as well as the effective date of the modification, on the Services or on Hihru’s website, or will publicize the same to Users by notifying Users in the manner prescribed by Hihru.
The modified version of these Terms and Conditions shall become effective as of the effective date thereof.
4.Account
4.1.When using the Services, Users may need to set up an account by registering certain information. Users must register true, accurate and complete information, and must revise the same to keep such information up-to-date at all times.
4.2.If Users register any authentication information when using the Services, they must exercise due care in handling such information at their own responsibility to ensure that such information is not used in an unlawful manner. Hihru may treat any and all activities conducted under the authentication information as activities that have been conducted by the User with whom the authentication information is registered.
4.3.Any User who has registered for the Services may delete such User’s account and cancel the Services at any time.
4.4.Hihru reserves the right to delete any account that has been inactive for a period of one (1) year or more since its last activation, without any prior notice to the applicable User.
4.5.Any and all rights of a User to use the Service shall cease to exist when such User’s account has been deleted for any reason. Please take note that an account cannot be retrieved even if a User has accidentally deleted their account.
4.6.Each account in the Services is for exclusive use and belongs solely to the User of such account. Users may not transfer, lease or otherwise dispose their rights to use the Service to any third party, nor may the same be inherited or succeeded to by any third party.
5.Privacy
5.1.Hihru places top priority on the privacy of its Users.
5.2.Hihru will appropriately handle privacy information and personal information of Users in accordance with the Hihru Privacy Policy.
5.3.Hihru promises to exercise the utmost care and attention to its security measures to ensure the safe management of any and all information collected from Users.
6.Provision of the Service
6.1.Users shall supply PCs, mobile phone devices, smartphones and other communication devices, operating systems, communication methods and electricity, etc. necessary for using the Services at their own responsibility and expense.
6.2.Hihru reserves the right to limit access to all or part of the Services by Users depending upon conditions that Hihru considers necessary, such as the age and identification of User, current registration status, and the like.
6.3.Hihru reserves the right to modify, at Hihru's discretion, all or part of the Services as Hihru determines necessary anytime without any prior notice to Users.
6.4.Hihru may cease providing all or part of the Services without any prior notice to Users in case of the occurrence of any of the following:
(1)When conducting maintenance or repair of systems;
(2)When the Services cannot be provided due to force majeure such as an accident (fire, power outage, etc.), act of God, war, riot, labor dispute;
(3)When there is system failure or heavy load on the system;
(4)When securing the safety of Users or third parties, or in the case of an emergency for the public welfare; or
(5)When Hihru reasonably determines it to be necessary, other than those set forth in items (1) through (4).
7.No Emergency Call Functions
The Services cannot be depended upon for emergency calls, such as those made to law enforcement agencies, maritime safety authorities, fire brigade or other emergency services.
8.Advertisements
Hihru reserves the right to post advertisements for Hihru or a third party on the Services.
9.Third-Party Services
The Services may contain services or Contents provided by third parties other than Hihru. Such third parties shall bear any and all responsibility regarding such services and/or Contents. Furthermore, there may be terms or use or other terms and conditions provided by such third party which are applicable to such services and Contents.
10.Contents
10.1.Hihru grants Users a non-transferable, non-sublicensable, non-exclusive license to use the Subject Contents provided by Hihru, solely for the purpose of using the Services.
10.2.Users shall abide by the conditions applicable thereto when using the Subject Contents which are subject to conditions of use, such as additional fees and periods of use and the like. Even if terms such as “Purchase”, “Sales,” and the like appear on the screens for the Services, Hihru shall remain the owner of all intellectual property rights as well as all other rights in the Subject Contents offered to Users by Hihru, and such rights shall not be transferred to Users. Users will only be granted usage rights as set forth above.
10.3.Users shall not use the Subject Contents beyond the scope of the intended use of the Subject Contents in the Services (including, without limitation, acts of copying, transmitting, reproducing, and modifying).
10.4.If Users wish to back-up all or part of the Submitted Contents, they will need to do so themselves. Hihru will not undertake the obligation of backing up any of the Submitted Contents.
10.5.The Services may include functions where multiple Users may edit Contents (post, correct, and delete, etc.). In such case, a User who posted his/her Submitted Contents shall grant other Users the right to edit such Submitted Contents.
10.6.Users shall retain their rights to their Submitted Contents, and Hihru shall not acquire any such rights; provided, however, that, among the Submitted Contents, for those made available to other Users generally (i.e., not just to the User's “follower & following”), the User who posted such Submitted Contents shall be deemed to have granted Hihru a worldwide, perpetual, royalty-free license (including the right to amend (such as abbreviating) such Contents to the extent Hihru deems necessary and appropriate, and the right to sublicense such usage rights to other third parties working together with Hihru), to use such Contents for services and/or promotional purposes.
10.7.Users shall not exercise their rights such as author’s moral rights with respect to the Submitted Contents in relation to the use by Hihru or a third party under Articles 10.5 and 10.6 above.
10.8.Hihru may check and confirm the contents of the Submitted Contents by Users to the extent permissible under laws and regulations, when it is necessary for Hihru to confirm compliance with related laws and regulations or the provisions set out in these Terms and Conditions, etc.; provided, however, that Hihru is not obligated to conduct such confirmation.
10.9.If Hihru believes that a User has violated or may violate any applicable laws or regulations or the provisions of these Terms and Conditions in relation to the Submitted Contents, or when otherwise reasonably necessary for Hihru’s business, then Hihru reserves the right to preclude such User's use of the Services in certain manners, such as deleting the Submitted Contents without providing prior notice to the User.
11.Provision of Subscription Services
11.1.Users may receive services in exchange for payment of a fee or under the terms and conditions prescribed by Hihru, wherein the Users pay a certain amount of considerations to use certain Subject Contents designated by Hihru for a certain period of time (the “Subscription Services”). Users shall abide by these Terms and Conditions, the fees for the Subscription Services, the payment method thereof, as well as other terms and conditions of use posted on the Services or on Hihru’s website.
11.2.Users may take procedures for the cancellation of Subscription Services at any time; provided, however, that even if a User takes the procedures for cancellation prior to the intended period of use, the User may not change such period of use, nor may the User cancel the purchase of the Subscription Services. In such case, the fees already paid will not be refunded, nor will there be any refund on a pro rata basis. However, the foregoing will not apply if laws or regulations require otherwise.
11.3.If a User does not complete their cancellation procedure by the designated date and time, the period of use of the Subscription Services may be automatically renewed in accordance with the terms prescribed by Hihru even after the end of the period of use of such Subscription Services.
12.Restricted Matters
Hihru prohibits Users from engaging in any of the following acts when using the Services:
12.1.Acts that violate the laws and regulations, court verdicts, resolutions or orders, or administrative measures that are legally binding;
12.2.Acts that may be in violation of public order, morals or customs;
12.3.Acts that infringe intellectual property rights, such as copyrights, trademarks and patent rights, rights to fame, privacy, and all other rights granted by law or by a contract with Hihru and/or a third party;
12.4.Acts of posting or transmitting excessively violent or explicit sexual expressions; expressions that amount to child pornography or child abuse; expressions that lead to discrimination by race, national origin, creed, gender, social status, family origin, etc.; expressions that induce or encourage suicide, self-injurious behavior or drug abuse; or expressions that include anti-social content and lead to the discomfort of others;
12.5.Acts that lead to the misrepresentation of Hihru and/or a third party or that intentionally spread false information;
12.6.Acts of sending the same or similar messages to a large, indefinite number of Users (except for those approved by Hihru), indiscriminately adding other Users as friends or to group chats, or any other acts deemed by Hihru to constitute spamming;
12.7.Acts of exchanging the right to use the Services or Contents into cash, property or other economic benefits, other than by using the method prescribed by Hihru;
12.8.Acts of using the Services for sales, marketing, advertising, solicitation or other commercial purposes (except for those approved by Hihru); using the Services for the purpose of sexual conduct or obscene acts; using the Services for the purpose of meeting or engaging in sexual encounters with an unknown third party; using the Services for the purpose of harassment or libelous attacks against other Users; or otherwise using the Services for purposes other than as intended by the Services;
12.9.Acts that benefit or involve collaboration with anti-social groups;
12.10.Acts that are related to religious activities or invitations to certain religious groups;
12.11.Acts of unauthorized or improper collection, disclosure, or provision of any other person's personal information, registered information, user history, or the like;
12.12.Acts of interfering with the servers and/or network systems of the Services; fraudulently manipulating the Services by means of bots, cheat tools, or other technical measures; deliberately using defects of the Services; making unreasonable inquires and/or undue claims such as repeatedly asking the same questions beyond what is necessary, and other acts of interfering with or hindering Hihru's operation of the Services or other Users’ use of the Services;
12.13.Acts of decoding the source code of the Services, such as by way of reverse engineering, disassembling or the like, for unreasonable purposes or in an unfair manner;
12.14.Acts that aid or encourage any acts stated in Clauses 13.1 to 13.13 above; and
12.15.Acts other than those set forth in Clauses 13.1 to 13.14 that Hihru reasonably deems to be inappropriate.
13.User Responsibility
13.1.Users shall use the Services at their own risk, and shall bear any and all responsibilities for actions carried out under and the results from the use of the Services.
13.2.Hihru may suspend the use of all or part of the Services, suspend or delete accounts, cancel any agreement between a User and Hihru with respect to the Services (including, without limitation, any agreement based on these Terms and Conditions, hereinafter the same) or take any other measure Hihru reasonably determines to be necessary and appropriate without prior notice to such User in the case that such User falls under or there is a possibility that such User falls under any of the following items:
(1)A User is in breach of applicable laws and regulations, these Terms and Conditions, or any Separate Terms and Conditions;
(2)A User is a member of an anti-social group or a related party thereof;
(3)A User tarnishes Hihru’s credibility by spreading false information, using fraudulent means or force, or other unlawful means;
(4)A User is subject to a petition for attachment, provisional attachment, or auction, ; procedures such as bankruptcy, civil rehabilitation, or similar procedures are commenced; or Hihru otherwise reasonably determines that there is uncertainty with respect to User’s credibility; or
(5)The relationship of trust with a User is lost or Hihru otherwise reasonably determines that it would not be appropriate for Hihru to provide the Services to User, due to reasons other than as set forth in items (1) to (4) above.
13.3.In the case where Hihru suffers loss/damages either directly or indirectly (including, without limitation, attorney fees) due to a User’s use of the Services (including, without limitation, cases where Hihru receives a complaint from a third party due to such use), the User shall immediately compensate Hihru for such loss/damage in accordance with Hihru’s request.
14.NO WARRANTY
HIHRU SHALL PROVIDE NO WARRANTY, EITHER EXPRESSLY OR IMPLIEDLY, WITH RESPECT TO THE SERVICES (INCLUDING THE SUBJECT CONTENTS), THAT THERE ARE NO DEFECTS (INCLUDING, WITHOUT LIMITATION, FAULTS WITH RESPECT TO SECURITY, ETC., ERRORS OR BUGS, OR VIOLATIONS OF RIGHTS) OR AS TO THE SAFETY, RELIABILITY, ACCURACY, COMPLETENESS, EFFECTIVENESS AND FITNESS FOR A PARTICULAR PURPOSE. HIHRU WILL IN NO WAY BE RESPONSIBLE FOR PROVIDING USERS WITH THE SERVICES AFTER DELETING SUCH DEFECTS.
15.HIHRU's LIMITATION OF LIABILITY
15.1.HIHRU WILL NOT BE LIABLE FOR ANY DAMAGE INCURRED BY USERS FROM THE USE OF THE SERVICES, UNLESS SUCH DAMAGE IS ATTRIBUTABLE TO THE INTENTIONAL OR GROSSLY NEGLIGENT ACTS OF Hihru; PROVIDED, HOWEVER, THAT, IN THE CASE THAT THE AGREEMENT BETWEEN THE USER AND HIHRU WITH RESPECT TO THE USE OF THE SERVICES FALLS UNDER A CONSUMER CONTRACT AS DEFINED UNDER THE CONSUMER CONTRACT ACT OF THAILAND (“CONSUMER CONTRACT”), Hihru WILL BE LIABLE TO PROVIDE COMPENSATION FOR DAMAGE ARISING DUE TO NEGLIGENCE ON THE PART OF Hihru (EXCLUDING GROSS NEGLIGENCE) ARISING FROM CONTRACT OR TORT ONLY WITHIN THE RANGE OF (A) THE DAMAGE WHICH IS NORMALLY INCURRED (I.E., EXCLUSIVE OF LOST PROFITS AND OTHER DAMAGES ARISING UNDER SPECIAL CIRCUMSTANCES), AND (B) THE AMOUNT OF USAGE FEES FOR THE SERVICES RECEIVED FROM SUCH USER FOR FEE-BASED SERVICES FOR THE MONTH IN WHICH SUCH DAMAGE HAS BEEN INCURRED, AT MAXIMUM.
15.2.IF A USER INCURS DAMAGE AS A RESULT OF GROSS NEGLIGENCE ON THE PART OF HIHRU, HIHRU WILL BE RESPONSIBLE TO PROVIDE COMPENSATION FOR THE DAMAGE INCURRED BUT ONLY WITHIN THE RANGE OF (A) THE DAMAGE WHICH IS NORMALLY INCURRED (I.E., EXCLUSIVE OF LOST PROFITS AND OTHER DAMAGES ARISING UNDER SPECIAL CIRCUMSTANCES), AND (B) THE AMOUNT OF USAGE FEES FOR THE SERVICES RECEIVED FROM SUCH USER FOR FEE-BASED SERVICES FOR THE MONTH IN WHICH SUCH DAMAGE HAS BEEN INCURRED, AT MAXIMUM; PROVIDED, HOWEVER, THAT THE FOREGOING SHALL NOT APPLY IF THE AGREEMENT BETWEEN SUCH USER AND HIHRU FALLS UNDER THE DEFINITION OF A CONSUMER CONTRACT.
16.Relationship between these Terms and Conditions and Laws and Regulations
If the terms of these Terms and Conditions violate any laws and regulations applicable to an agreement between Users and Hihru with respect to the Services (including, without limitation, the Consumer Contract Act of Thailand), such terms, to the extent of such violation, shall not apply to the agreement with the Users; provided, however, that the remaining terms of these Terms and Conditions shall not be affected.
17.Notification and Contact
17.1.For notifications from Hihru to Users regarding the Services, Hihru will use a method that Hihru considers appropriate, such as posting in an appropriate place within the Services or on Hihru’s website.
17.2.For notifications from Users to Hihru regarding the Services, Users shall use the customer inquiry form available on the Services or on Hihru’s website, or through other means designated by Hihru.
18.Governing Law and Jurisdiction
Where Hihru has provided Users with a translation of the Thai language version of these Terms and Conditions (the “Thai Version”), the Thai Version will govern the relationship between Users and Hihru. In the event of any conflict between the Thai Version and a translation thereof, the provisions in the Thai Version shall take precedence over any other translation. These Terms and Conditions will be governed by the laws of Thailand. Any conflicts between Users and Hihru that arise from or in connection with the Service shall be resolved under the exclusive jurisdiction of the Thailand Court as the court of first instance.
ข้อกำหนดและเงื่อนไขในการใช้งาน Hihru ฉบับนี้ ("ข้อกำหนดและเงื่อนไขฯ") ได้ระบุถึงข้อกำหนดและเงื่อนไขในการใช้งานผลิตภัณฑ์และบริการใดๆ (เรียกรวมกันว่า “บริการฯ”) ของ Hihru แก่ผู้ใช้บริการ (โดยแต่ละรายเรียกว่า "ผู้ใช้" หรือ “ผู้ใช้รายต่างๆ” ขึ้นอยู่กับเนื้อหา)
1.คำนิยาม
คำและข้อความดังต่อไปนี้ให้มีความหมายตามที่ได้กำหนดไว้ด้านล่างเมื่อมีการใช้ในข้อกำหนดและเงื่อนไขฯ ฉบับนี้
1.1."เนื้อหา" หมายถึง ข้อมูลต่างๆ เช่น ข้อความ เสียง เพลง รูปภาพ วิดีโอ ซอฟต์แวร์ โปรแกรม รหัสคอมพิวเตอร์ และข้อมูลอื่นๆ
1.2."เนื้อหาหลัก" หมายถึง เนื้อหาที่สามารถเข้าถึงได้ผ่านทางบริการฯ
1.3."เนื้อหาจากผู้ใช้" หมายถึง เนื้อหาที่ผู้ใช้ได้ส่ง ส่งผ่าน หรือ อัพโหลดบนระบบการให้บริการฯ
1.4."ข้อกำหนดและเงื่อนไขฯ เพิ่มเติม" หมายถึง ข้อกำหนดและเงื่อนไขอื่นใดซึ่งแยกต่างหากจากข้อกำหนดและเงื่อนไขฯ ฉบับนี้ และเกี่ยวข้องกับบริการฯ ซึ่งเผยแพร่หรืออัพโหลดโดย Hihru ภายใต้ชื่อ "ข้อตกลง" "แนวทางปฏิบัติ" "นโยบาย" หรือภายใต้ชื่ออื่นๆ ที่มีความหมายคล้ายคลึงกัน
2.การตกลงยอมรับข้อกำหนดและเงื่อนไขฯ ฉบับนี้
2.1.ผู้ใช้ทุกรายจะต้องใช้บริการฯ ตามข้อกำหนดที่ระบุไว้ในข้อกำหนดและเงื่อนไขฯ ฉบับนี้ โดยผู้ใช้จะไม่สามารถใช้บริการฯ ได้เว้นเสียแต่ผู้ใช้ได้ตกลงยอมรับข้อกำหนดและเงื่อนไขฯ ฉบับนี้แล้ว
2.2.ผู้ใช้ซึ่งเป็นผู้เยาว์จะสามารถใช้บริการฯ ได้ก็ต่อเมื่อได้รับความยินยอมล่วงหน้าจากบิดามารดาหรือผู้แทนโดยชอบกฎหมายเท่านั้น นอกจากนี้ หากผู้ใช้ดังกล่าวใช้บริการฯ ในนามหรือเพื่อวัตถุประสงค์ขององค์กรธุรกิจใด ให้ถือว่าองค์กรธุรกิจดังกล่าวได้ตกลงยอมรับข้อกำหนดและเงื่อนไขฯ ฉบับนี้แล้วล่วงหน้า
2.3.หากมีข้อกำหนดและเงื่อนไขฯ เพิ่มเติมใดๆ ซึ่งเกี่ยวข้องกับการให้บริการฯ ผู้ใช้จะต้องปฏิบัติตามข้อกำหนดและเงื่อนไขฯ เพิ่มเติมดังกล่าวเช่นเดียวกับข้อกำหนดและเงื่อนไขฯ ในการใช้งานฉบับนี้
3.การแก้ไขข้อกำหนดและเงื่อนไขฯ ฉบับนี้
Hihru อาจเปลี่ยนแปลงแก้ไขข้อกำหนดและเงื่อนไขฯ ฉบับนี้ได้ตลอดเวลาตามที่ Hihru เห็นสมควรซึ่งจะอยู่ภายใต้ขอบวัตถุประสงค์ของข้อกำหนดและเงื่อนไขฯ ฉบับนี้ ในกรณีดังกล่าว Hihru จะแจ้งเนื้อหาของข้อกำหนดฉบับแก้ไขรวมถึงวันที่มีผลบังคับใช้บนเว็บไซต์ของ Hihru หรืออาจแจ้งให้ผู้ใช้ทราบด้วยวิธีการอื่นใดตามที่ Hihru กำหนด ทั้งนี้ ข้อกำหนดและเงื่อนไขฉบับแก้ไขจะมีผลบังคับใช้ตามวันที่กำหนดต่อไป
4.บัญชี
4.1.เมื่อใช้บริการฯ ผู้ใช้อาจมีความจำเป็นต้องลงทะเบียนการใช้บริการฯ ด้วยข้อมูลบางประการ ทั้งนี้ ผู้ใช้ต้องให้ข้อมูลที่เป็นความจริง ถูกต้อง ครบถ้วนและมีหน้าที่ต้องปรับปรุงและแก้ไขข้อมูลดังกล่าวให้เป็นปัจจุบันอยู่เสมอ
4.2.ในกรณีที่ผู้ใช้ลงทะเบียนข้อมูลการยืนยันตัวตนใดๆ (Authentication information) เมื่อใช้บริการฯ ผู้ใช้ต้องใช้ความระมัดระวังในการจัดการข้อมูลดังกล่าวด้วยความรับผิดชอบของตน เพื่อให้เป็นที่เน่ใจว่าข้อมูลดังกล่าวจะไม่ถูกนำไปใช้ในลักษณะที่ไม่ชอบด้วยกฎหมาย ทั้งนี้ Hihru อาจถือว่ากิจกรรมใดๆ ซึ่งดำเนินการโดยการใช้ข้อมูลการรับรองตัวตนดังกล่าว เสมือนเป็นกิจกรรมที่ผู้เป็นเจ้าของข้อมูลได้ดำเนินการด้วยตนเองทั้งสิ้น
4.3.ผู้ใช้ซึ่งลงทะเบียนใช้บริการฯ สามารถลบบัญชีของตนและยกเลิกการใช้บริการฯ ได้ไม่ว่าในเวลาใด
4.4.Hihru ขอสงวนสิทธิในการลบบัญชีใดๆ ซึ่งไม่มีการเปิดใช้งานเป็นเวลากว่า หนึ่ง (1) ปี หรือนานกว่านับแต่วันที่มีการเปิดใช้งานบัญชีดังกล่าวครั้งล่าสุด ทั้งนี้ โดยไม่ต้องบอกกล่าวล่วงหน้าใดๆ แก่ผู้ใช้บัญชีดังกล่าว
4.5.สิทธิใดๆ ของผู้ใช้บริการอาจสิ้นสุดลงเมื่อบัญชีของผู้ใช้ดังกล่าวถูกลบไม่ว่าด้วยเหตุผลประการใดๆ ทั้งนี้ บัญชีการใช้บริการฯ จะไม่สามารถกู้คืนได้ถึงแม้ว่าผู้ใช้บริการฯ จะลบบัญชีของตนโดยไม่ได้ตั้งใจก็ตาม
4.6.บัญชีแต่ละบัญชีในการใช้บริการฯ นั้น มีไว้เพื่อการใช้งานเฉพาะบุคคลและเป็นของเจ้าของบัญชีนั้นแต่เพียงผู้เดียว ผู้ใช้ไม่สามารถโอน ให้ยืม หรือจำหน่ายสิทธิในการใช้บัญชีของตนแก่บุคคลภายนอก ขณะเดียวกันบุคคลภายนอกก็ไม่สามารถรับช่วงสิทธิหรือสืบทอดบัญชีจากผู้ใช้ดังกล่าวได้เช่นกัน
5.การคุ้มครองข้อมูลส่วนบุคคล
5.1.Hihru ให้ความสำคัญแก่ความเป็นส่วนตัวของผู้ใช้บริการฯ เป็นลำดับแรก
5.2.Hihru จะคุ้มครองความเป็นส่วนตัวและข้อมูลส่วนบุคคลของผู้ใช้บริการฯ อย่างเหมาะสมตาม "นโยบายความเป็นส่วนตัว"
5.3.Hihru สัญญาที่จะใช้ความระมัดระวังและความเอาใส่ใจอย่างสูงสุดกับมาตรการรักษาความปลอดภัย เพื่อให้แน่ใจว่ามีการจัดการข้อมูลใดๆ ซึ่งเก็บรวบรวมจากผู้ใช้บริการฯ อย่างเหมาะสมและปลอดภัย
6.การให้บริการฯ
6.1.ผู้ใช้จะเป็นผู้รับผิดชอบจัดหาเครื่องคอมพิวเตอร์ อุปกรณ์สื่อสารเคลื่อนที่ สมาร์ทโฟน อุปกรณ์สื่อสารอื่นๆ ระบบปฏิบัติการ วิธีการเชื่อมต่อสื่อสารและกระแสไฟฟ้า ฯลฯ ซึ่งจำเป็นต่อการใช้บริการฯ ทั้งนี้ ผู้ใช้เป็นผู้ออกค่าใช้จ่ายเองทั้งสิ้น
6.2.Hihru ขอสงวนสิทธิในการจำกัดการเข้าถึงการใช้บริการฯ ทั้งหมดหรือแต่บางส่วนของผู้ใช้บริการฯ การสงวนสิทธิดังกล่าวขึ้นอยู่กับเงื่อนไขที่ Hihru เห็นสมควร เช่น อายุและการระบุตัวตนของผู้ใช้บริการฯ การลงทะเบียน สถานภาพ และองค์ประกอบอื่นใดที่มีความคล้ายคลึงกัน
6.3.Hihru ขอสงวนสิทธิในการแก้ไขหรือเปลี่ยนแปลงข้อกำหนดและเงื่อนฯ ในการใช้บริการทั้งหมดหรือแต่บางส่วนไม่ว่าในเวลาใด ตามที่ Hihru เห็นสมควร ทั้งนี้ โดยไม่ต้องบอกกล่าวล่วงหน้าแก่ผู้ใช้
6.4.Hihru อาจหยุดการให้บริการฯ ทั้งหมดหรือแต่บางส่วนโดยไม่ต้องบอกกล่าวล่วงหน้าแก่ผู้ใช้ในกรณีดังต่อไปนี้
(1)เมื่อทำการบำรุงรักษาหรือซ่อมแซมระบบ
(2)เมื่อไม่สามารถให้บริการได้เนื่องจากเหตุสุดวิสัยบางประการ เช่น อุบัติเหตุ (ไฟไหม้ไฟดับ ฯลฯ ) ปรากฏการณ์ธรรมชาติ สงคราม การจลาจล และข้อพิพาทแรงงาน
(3)เมื่อระบบเกิดความขัดข้องหรือมีการใช้งานระบบมากเกินกำลัง (Overload)
(4)เพื่อรักษาความปลอดภัยของผู้ใช้หรือบุคคลภายนอกหรือเพื่อดำเนินภาระกิจอันเป็นประโยชน์ต่อสาธารณะในกรณีฉุกเฉิน
(5)เมื่อ Hihru เห็นว่ามีความจำเป็นและเป็นการสมควรนอกจากกรณีที่ได้ระบุไว้ในข้อ (1) ถึง (4) ข้างต้น
7.การแจ้งเหตุฉุกเฉิน
ผู้ใช้ไม่สามารถพึ่งพาบริการฯ นี้เป็นบริการหลักในการแจ้งเหตุฉุกเฉินได้ ไม่ว่าจะเป็นการแจ้งเหตุไปยังหน่วยงานบังคับใช้กฎหมาย หน่วยงานด้านความปลอดภัยทางทะเล หน่วยงานดับเพลิง หรือหน่วยงานอื่นๆ ซึ่งให้บริการฉุกเฉิน
8.โฆษณา
Hihru ขอสงวนสิทธิที่ในการโฆษณาของ Hihru หรือของบุคคลภายนอกบนระบบการให้บริการฯ
9.ผู้ให้บริการภายนอก
การให้บริการฯ นี้อาจมีเนื้อหาฯ หรือบริการอื่นใดซึ่งให้บริการหรือจัดทำโดยผู้ให้บริการภายนอก ในการนี้ผู้ให้บริการภายนอกดังกล่าวจะเป็นผู้รับผิดชอบแต่เพียงผู้เดียวเกี่ยวกับเนื้อหาฯ และ/หรือการให้บริการดังกล่าว นอกจากนี้ เนื้อหาฯ หรือบริการฯ ดังกล่าวอาจตกอยู่ภายใต้ข้อกำหนด การใช้ หรือข้อกำหนดและเงื่อนไขอื่นใดซึ่งผู้ให้บริการภายนอกได้กำหนดไว้สำหรับเนื้อหาและบริการนั้นๆ
10.เนื้อหา
10.1.Hihru อนุญาตให้ผู้ใช้ใช้บริการฯ เนื้อหาหลักที่จัดให้เพื่อวัตถุประสงค์ในการใช้บริการฯ ของผู้ใช้โดยไม่จำกัดจำนวนผู้ใช้ อย่างไรก็ตามผู้ใช้ไม่สามารถส่งหรือโอน อนุญาตช่วง หรืออนุญาตให้ใช้สิทธิ แก่บุคคลภายนอกได้ (non-transferable, non-re-licensable, non-exclusive license)
10.2.ผู้ใช้จะต้องปฏิบัติตามเงื่อนไขที่มีผลบังคับใช้ เมื่อใช้เนื้อหาหลักซึ่งอยู่ภายใต้ข้อกำหนดและเงื่อนไขฯ ฉบับนี้ เช่น ค่าธรรมเนี่ยมเพิ่มเติม ระยะเวลาในการใช้บริการฯ และเงื่อนไขอื่นใดซึ่งมีความคล้ายคลึงกัน ถึงแม้ว่าจะมีถ้อยคำดังต่อไปนี้ปรากฏบนหน้าจอในการใช้บริการฯ เช่น "การซื้อ" "การขาย" และถ้อยคำอื่นๆ ซึ่งมีความหมายคล้ายคลึงกัน ในกรณีนี้ Hihru จะยังคงเป็นเจ้าของสิทธิในทรัพย์สินทางปัญญารวมถึงสิทธิอื่นๆ ทั้งหมดในเนื้อหาหลักที่ Hihru เป็นผู้ให้บริการแก่ผู้ใช้ซึ่งสิทธิดังกล่าวจะไม่ถูกโอนไปให้แก่ผู้ใช้แต่อย่างใด ผู้ใช้จะได้รับสิทธิในการใช้งานตามที่ได้ระบุไว้ข้างต้นเท่านั้น
10.3.ผู้ใช้จะต้องไม่ใช้เนื้อหาหลักเกินจากขอบวัตถุประสงค์ของการใช้บริการฯ (ซึ่งรวมถึงแต่ไม่จำกัดเพียงการทำสำเนา การส่ง การทำซ้ำ และการแก้ไขเปลี่ยนแปลง)
10.4.ในกรณีที่ผู้ใช้ต้องการที่จะสำรองเนื้อหาจากผู้ใช้ (Back-up) ไม่ว่าทั้งหมดหรือเพียงบางส่วน ผู้ใช้จะต้องดำเนินการดังกล่าวด้วยตนเอง Hihru ไม่มีหน้าที่และภาระในการสำรองเนื้อหาจากผู้ใช้แต่อย่างใด
10.5.บริการฯ อาจรวมถึงกระบวนการการทำงาน (ฟังก์ชั่น) ต่างๆ ซึ่งผู้ใช้หลายคนสามารถที่จะแก้ไขเนื้อหาได้ (โพสต์ ตรวจสอบความถูกต้อง และการลบเป็นต้น) ในกรณีดังกล่าวผู้ใช้ซึ่งโพสต์เนื้อหาดังกล่าวจะต้องอนุญาตให้ผู้ใช้รายอื่นแก้ไขเนื้อหาของตนได้
10.6.ผู้ใช้จะยังคงมีสิทธิที่เกี่ยวกับเนื้อหาจากผู้ใช้อยู่เช่นเดิม และ Hihru จะไม่ได้มาซึ่งสิทธิใดๆ ในเนื้อหาดังกล่าว อย่างไรก็ตามผู้ใช้ซึ่งโพสต์เนื้อหาที่มีความเป็นสาธารณะสามารถเข้าถึงได้เป็นการทั่วไป (ไม่จำกัดเพียง "คนที่ติดตามเรา หรือ คนที่เราติดตาม" ของผู้ใช้เท่านั้น) ให้ถือว่าผู้ใช้ซึ่งโพสต์เนื้อหาดังกล่าวได้รับสิทธิต่างๆ จาก Hihru ให้สามารถใช้เนื้อหาดังกล่าวเพื่อให้บริการและ/หรือเพื่อวัตถุประสงค์ในการส่งเสริมการตลาดได้ (สิทธิต่างๆ ในที่นี้รวมถึง สิทธิในการแก้ไขเนื้อหาในขอบเขตที่ Hihru เห็นว่ามีความจำเป็นและเหมาะสม เช่น การใช้อักษาย่อเป็นต้น และสิทธิในการให้อนุญาตช่วงให้แก่บุคคลภายนอกในการทำงานร่วมกับ Hihru เป็นต้น)
10.7.ผู้ใช้ต้องไม่ใช้สิทธิของตน เช่น สิทธิทางศีลธรรมที่เกี่ยวข้องกับเนื้อหาจากผู้ใช้ในส่วนที่เกี่ยวกับการใช้งานโดย Hihru หรือบุคคลถายนอกภายใต้ข้อ 10.5 และ ข้อ 10.6 ข้างต้น
10.8.Hihru อาจทำการตรวจสอบรายละเอียดและยืนยันเนื้อหาจากผู้ใช้ภายใต้ขอบเขตที่กฎหมายกำหนด หาก Hihru เห็นว่ามีความจำเป็นเพื่อที่จะปฏิบัติตามกฎหมาย ข้อบังคับ หรือข้อกำหนดและเงื่อนไขฯ ฉบับนี้ อย่างไรก็ตาม Hihru ไม่มีภาระหน้าที่จะต้องดำเนินการตรวจสอบดังกล่าวแต่อย่างไร
10.9.หาก Hihru เห็นว่า ผู้ใช้ได้ฝ่าฝืนหรืออาจฝ่าฝืนกฎหมาย กฎระเบียบ หรือข้อกำหนดและเงื่อนไขฯ ฉบับนี้ ซึ่งเกี่ยวข้องกับเนื้อหาจากผู้ใช้ หรือเกี่ยวข้องกับการดำเนินกิจการของ Hihru เราขอสงวนสิทธิที่จะตัดสิทธิผู้ใช้ในการที่ใช้เนื้อหาในบางลักษณะ เช่น การลบเนื้อหาจากผู้ใช้ โดยไม่ต้องบอกกล่าวล่วงหน้า เป็นต้น
11.บริการสมัครสมาชิก
11.1.ผู้ใช้อาจได้รับบริการฯ โดยมีค่าใช้จ่ายหรือค่าธรรมเนียมหรือได้รับบริการฯ ภายใต้ข้อกำหนดและเงื่อนไขของ Hihru ทั้งนี้ ผู้ใช้อาจต้องชำระค่าบริการบางส่วนเพื่อใช้งานเนื้อหาหลักของ Hihru ภายในระยะเวลาที่กำหนด (“บริการสมัครสมาชิกฯ”) ผู้ใช้จะต้องปฏิบัติตามข้อกำหนดและเงื่อนไขเหล่านี้ค่าธรรมเนียมสำหรับบริการสมัครสมาชิกฯ วิธีการชำระเงิน และเงื่อนไขการใช้งานอื่นๆ ซึ่งถูกกำหนดและแสดงอยู่บนระบบการให้บริการฯ หรือบนเว็ปไซต์ของ Hihru
11.2.ผู้ใช้สามารถดำเนินการตามขั้นตอนเพื่อขอยกเลิกการให้บริการสมัครสมาชิกฯ ได้ตลอดเวลา อย่างไรก็ตามหากผู้ใช้ดำเนินตามขั้นตอนเพื่อขอยกเลิกการให้บริการฯ ดังกล่าวก่อนระยะเวลาการใช้งานที่กำหนด ผู้ใช้อาจไม่สามารถยกเลิกการซื้อบริการสมัครสมาชิกฯ ดังกล่าวได้ ในกรณีนี้ ค่าธรรมเนียมซึ่งผู้ใช้ได้ชำระไปแล้วนั้นไม่สามารถขอเรียกรับเงินคืนได้ อย่างไรก็ตามข้อกำหนดนี้อาจไม่มีผลบังคับใช้หากมีกฎหมายให้อำนาจไว้เป็นอื่น
11.3.ในกรณีที่ผู้ใช้ไม่สามารถดำเนินการยกเลิกบริการสมัครสมาชิกฯ ตามวันและเวลาที่กำหนด ระยะเวลาในการให้บริการสมัครสมาชิกฯ ของท่านอาจได้รับการต่ออายุโดยอัตโนมัติ ถึงแม้ว่าจะสิ้นสุดระยะเวลาใช้บริการสมัครสมาชิกดังกล่าวแล้วก็ตาม ทั้งนี้ เป็นไปตามเงื่อนไขที่ Hihru กำหนด
12.ข้อจำกัดการใช้งาน
ผู้ใช้ไม่สามารถกระทำการดังต่อไปนี้เมื่อใช้บริการฯ ได้ ตามที่ Hihru กำหนด
12.1.การกระทำที่ฝ่าฝืนกฎหมาย ข้อบังคับ คำพิพากษา มติหรือคำสั่งศาล หรือมาตรการทางปกครองที่มีผลผูกพันทางกฎหมาย
12.2.การกระทำที่อาจขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชน
12.3.การกระทำที่ละเมิดสิทธิในทรัพย์สินทางปัญญา เช่น ลิขสิทธิ์ เครื่องหมายการค้าและสิทธิบัตร สิทธิในชื่อเสียง ความเป็นส่วนตัว และสิทธิอื่นๆ ทั้งหมดที่ได้รับตามกฎหมายหรือตามสัญญากับ Hihru และ/หรือบุคคลที่สาม
12.4.การกระทำที่แสดงหรือส่งต่อซึ่งการแสดงออกที่มีลักษณะรุนแรงหรือเกี่ยวข้องกับเพศอย่างชัดเจน การแสดงออกซึ่งภาพอนาจารของเด็กหรือเยาวชนหรือการทารุณกรรมเด็ก การแสดงออกซึ่งนำไปสู่การเลือกปฏิบัติทางด้านเชื้อชาติ สัญชาติ ความเชื่อ เพศ สถานะทางสังคม ถิ่นกำเนิด ครอบครัว และอื่นๆ ที่เกี่ยวข้อง การแสดงออกที่ชักชวนหรือส่งเสริมการฆ่าตัวตาย พฤติกรรมการทำร้ายตัวเอง การใช้ยาในทางที่ผิด หรือการแสดงออกใดๆ ซึ่งเป็นการต่อต้านสังคมอันประกอบด้วยเนื้อหาที่ต่อต้านสังคมและทำให้บุคคลอื่นเกิดความไม่สบายใจเป็นต้น
12.5.การกระทำที่อาจทำให้ผู้อื่นเข้าใจผิดเกี่ยวกับ Hihru และ/หรือบุคคลภายนอกหรือการจงใจเผยแพร่ข้อมูลเท็จ
12.6.กระทำต่างๆ เช่น การส่งข้อความซึ่งมีเนื้อหาเหมือนหรือคล้ายคลึงกันไปให้แก่ผู้ใช้เป็นจำนวนมาก (ยกเว้นข้อความที่ได้รับความเห็นชอบจาก Hihru) การเพิ่มผู้ใช้รายอื่นเป็นเพื่อนหรือการแชทเป็นกลุ่มแบบสุ่ม หรือการกระทำอื่นใดที่ Hihru ถือว่าเป็นการส่งข้อความรบกวน (spamming)
12.7.การกระทำที่เป็นการแลกเปลี่ยนสิทธิในการใช้เนื้อหาฯ เป็นเงินสด ทรัพย์สินหรือผลประโยชน์ทางการเงินอื่นๆ นอกเสียจากที่ Hihru กำหนดไว้
12.8.การกระทำที่มีการใช้บริการฯ เพื่อการขาย การตลาด การโฆษณา การชักชวน หรือวัตถุประสงค์ทางการค้าอื่นๆ (ยกเว้นวัตถุประสงค์ที่ได้รับความเห็นชอบจาก Hihru) การกระทำที่มีการใช้บริการฯ เพื่อการกระทำทางเพศหรือการกระทำที่อนาจาร การกระทำที่มีการใช้บริการฯ เพื่อวัตถุประสงค์ในการพบปะหรือนัดออกเดทกับบุคคลแปลกหน้าเพื่อการมีเพศสัมพันธ์ การกระทำที่ใช้บริการฯ เพื่อวัตถุประสงค์ในการคุกคาม หรือการหมิ่นประมาทใส่ร้ายผู้ใช้รายอื่นๆ หรือการกระทำใดๆ ซึ่งใช้บริการฯ เพื่อวัตถุประสงค์อื่นที่มิใช่จุดประสงค์ที่แท้จริงของการให้บริการฯ
12.9.การกระทำที่เป็นประโยชน์ต่อหรือมีส่วนร่วมกับกลุ่มที่ต่อต้านสังคม
12.10.การกระทำที่เกี่ยวกับกิจกรรมทางศาสนาหรือการเชื้อเชิญให้เข้ากลุ่มทางศาสนา
12.11.การกระทำที่เป็นการเก็บรวบรวม เปิดเผย หรือการให้ข้อมูลส่วนบุคคลของบุคคลอื่น ข้อมูลที่จดทะเบียน ประวัติผู้ใช้ หรือข้อมูลอื่นๆ ในทำนองเดียวกันโดยไม่ชอบด้วยกฎหมายหรือไม่เหมาะสม
12.12.การกระทำซึ่งเป็นการแทรกแซงเครื่องแม่ข่ายและ/หรือระบบเครือข่ายของการให้บริการฯ การกระทำซึ่งเป็นการใช้บริการฯ ในทางที่ผิดด้วยการใช้บ็อท (bots) เป็นเครื่องมือเพื่อโกงหรือด้วยวิธีการทางเทคนิคอื่นๆ การกระทำที่ใช้ข้อบกพร่องของการบริการฯ โดยไตร่ตรองไว้ก่อน การกระทำที่ทำการสอบถามคำถามซ้ำๆ เกินความจำเป็น และการกระทำที่เป็นการแทรกแซงการให้บริการฯ ของ Hihru หรือการใช้บริการฯ ของผู้ใช้
12.13.การถอดรหัสซอร์สโค้ดของบริการโดยวิธีวิศวกรรมย้อนกลับ (Reverse engineering) การถอดประกอบหรือสิ่งที่คล้ายคลึงกัน เพื่อวัตถุประสงค์ที่ไม่เหมาะสมหรือในลักษณะที่ไม่เป็นธรรม
12.14.การกระทำที่ให้ความช่วยเหลือหรือส่งเสริมกิจกรรมใดๆ ที่ระบุไว้ในข้อ 12.1 ถึงข้อ 12.13 ข้างต้น
12.15.การกระทำอื่นใด นอกเหนือจากที่ระบุในข้อ 12.1 ถึงข้อ 12.14 ที่บริษัทฯ เห็นว่าไม่เหมาะสม
13.ความรับผิดชอบของผู้ใช้
13.1.ผู้ใช้ต้องใช้บริการฯ นี้ด้วยเความเสี่ยงของตน และเป็นผู้รับผิดชอบแต่เพียงผู้เดียวต่อการกระทำทั้งหมดหรือการกระทำใดๆ ที่กระทำไปอันเรื่องมาจากการใช้บริการฯ นี้
13.2.Hihru อาจระงับการให้บริการฯ ทั้งหมดหรือแต่บางส่วน ลบบัญชีหรือยกเลิกข้อตกลงใด ๆ เกี่ยวกับการให้บริการระหว่างผู้ใช้และ Hihru (รวมถึงแต่ไม่จำกัดเพียง ข้อตกลงใด ๆ ตามข้อกำหนดและเงื่อนไขฯ ฉบับนี้) หรือใช้มาตรการอื่นใดที่ Hihru พิจารณาว่ามีความจำเป็นและเหมาะสมโดยไม่ต้องแจ้งให้ผู้ใช้ทราบล่วงหน้า ในกรณีที่ผู้ใช้รายนั้นกระทำการหรือไม่สามารถกระทำการอย่างหนึ่งอย่างใดดังต่อไปนี้
(1)ผู้ใช้ละเมิดกฎหมายที่เกี่ยวข้อง กฎระเบียบ ข้อกำหนดและเงื่อนไขฯ ฉบับนี้ หรือข้อกำหนดและเงื่อนไขฯ เพิ่มเติม
(2)ผู้ใช้เป็นสมาชิกของกลุ่มต่อต้านสังคมหรือกลุ่มคนที่มีความเกี่ยวข้องกับกลุ่มดังกล่าว
(3)ผู้ใช้ทำให้ Hihru เสื่อมเสียความน่าเชื่อถือโดยการเผยแพร่ข้อมูลเท็จ ใช้วิธีการโกง หรือวิธีการใดๆ อันไม่ชอบด้วยกฎหมาย
(4)ผู้ใช้ถูกร้องเรียน ถูกสั่งห้ามชั่วคราว ถูกขายทอดตลาด ถูกดำเนินคดีล้มละลาย ถูกฟื่นฟูกิจการ หรืออยู่ในกระบวรการซึ่งมีความหมายคล้ายคลึงกัน หรือ ด้วยเหตุผลอื่นใดตามที่ Hihru เห็นสมควรซึ่งเกี่ยวกับความสามารถในการชำระหนี้ของผู้ใช้
(5)Hihru สูญเสียความไว้วางใจต่อผู้ใช้ หรือเมื่อ Hihru เห็นว่าไม่ควรให้บริการฯ แก่ผู้ใช้ต่อไปด้วยเหตุผลนอกจากที่ได้กล่าวในข้อ (1) ถึงข้อ (4) ข้างต้น
13.3.ในกรณีที่เกิดความสูญเสียหรือความเสียหายแก่ Hihru ไม่ว่าทางตรงหรือทางอ้อม (ซึ่งรวมถึงโดยไม่จำกัดเพียงค่าทนายความ) เนื่องจากการใช้บริการฯ ของผู้ใช้ (ซึ่งรวมถึงโดยไม่จำกัดเพียงกรณีที่มีบุคคลภายนอกฟ้องร้องเรียกค่าเสียหายจาก Hihru เนื่องจากการใช้บริการฯ ดังกล่าว) ผู้ใช้มีหน้าที่ต้องชดใช้ค่าเสียหายให้แก่ Hihru ทันทีที่ Hihru ร้องขอ
14.ไม่รับประกันความเสียหาย
Hihru จะไม่รับประกันใด ๆ ไม่ว่าโดยชัดแจ้งหรือโดยปริยายเกี่ยวกับการให้บริการฯ แก่ผู้ใช้ (ซึ่งรวมถึงเนื้อหาหลักฯ) ว่าบริการฯ นั้นปราศจากข้อบกพร่องใดๆ (ข้อบกพร่องในที่นี่รวมถึงแต่ไม่จำกัดเพียง ข้อบกพร่องด้านความปลอดภัย ฯลฯ ข้อผิดพลาด บัค (BUGS) หรือการละเมิดสิทธิใดๆ) หรือมีความปลอดภัย มีความน่าเชื่อถือ มีความถูกต้องสมบูรณ์ มีประสิทธิภาพ และมีความเหมาะสมแก่การใช้ประโยชน์เฉพาะอย่าง ทั้งนี้ Hihru ไม่มีความรับผิดชอบในการที่จะต้องจัดหาบริการฯ ที่ไม่มีข้อบกพร่องดังกล่าวแต่อย่างใด
15.ข้อจำกัดความรับผิดของ Hihru
15.1.Hihru จะไม่รับผิดชอบใดๆ ต่อความเสียหายอันเกิดจากการกระทำของผู้ใช้ในการใช้บริการฯ เว้นเสียแต่ความเสียหายดังกล่าวมีส่วนเกิดจากการกระทำโดยเจตนาหรือโดยประมาทเลินเล่ออย่างร้ายแรงของ Hihru อย่างไรก็ตาม ในกรณีที่สัญญาให้บริการฯ ระหว่างผู้ใช้และ Hihru เป็นสัญญาผู้บริโภคซึ่งอยู่ใต้บังคับของพระราชบัญญัติสัญญาผู้บริโภคของประเทศไทย (“สัญญาผู้บริโภคฯ”) Hihru ต้องรับผิดชอบในการชดเชยค่าเสียหายที่เกิดขึ้นเนื่องจากความประมาทเลินเล่อเฉพาะส่วนของตน (ไม่รวมถึงการประมาทเลินเล่ออย่างร้ายแรง) ซึ่งเกิดขึ้นจากสัญญาหรือการละเมิดในขอบเขตดังต่อไปนี้ (A) ความเสียหายที่เกิดขึ้นตามปกติธรรมดา (ค่าเสียประโยชน์และค่าเสียหายพิเศษอื่นๆ เป็นต้น) และ (B) ค่าธรรมเนียมการใช้งานสูงสุดซึ่งได้จากการใช้บริการโดยมีค่าตอบแทนสำหรับในเดือนที่ความเสียหายดังกล่าวเกิดขึ้น
15.2. ในกรณีผู้ใช้ได้รับความเสียหายอันเนื่องมาจากการกระทำโดยประมาทเลินเล่ออย่างร้ายแรงของ Hihru Hihru มีหน้าที่ใช้ค่าสินไหมทดแทนอันเกิดจากการละเมิดนั้น อย่างไรก็ตามต้องอยู่ภายในขอบเขตดังต่อไปนี้ (A) ความเสียหายที่เกิดขึ้นตามปกติธรรมดา (ค่าเสียประโยชน์และค่าเสียหายพิเศษอื่นๆ เป็นต้น) และ (B) ค่าธรรมเนียมการใช้งานสูงสุดซึ่งได้จากการใช้บริการโดยมีค่าตอบแทนสำหรับในเดือนที่ความเสียหายดังกล่าวเกิดขึ้น อย่างไรก็ตามบทบัญญัติที่กล่าวมาข้างต้นอาจไม่มีผลใช้บังคับหาก สัญญาระหว่างผู้ใช้ดังกล่าวกับ Hihru เป็นสัญญาผู้บริโภคฯ
16.ความสัมพันธ์ระหว่างกฎหมาย กฎระเบียบ และข้อกำหนดและเงื่อนไขฯ ฉบับนี้
ในกรณีที่ข้อกำหนดข้อหนึ่งข้อใดของข้อกำหนดและเงื่อนไขฯ ฉบับนี้ละเมิดกฎหมายหรือกฎระเบียบใดๆ ซึ่งมีผลใช้บังคับแก่ข้อตกลงระหว่างผู้ใช้และ Hihru เกี่ยวกับการให้บริการ (ซึ่งรวมถึงแต่ไม่จำกัดเพียงพระราชบัญญัติสัญญาผู้บริโภคของประเทศไทย) ข้อบังคับดังกล่าวไม่มีผลใช้บังคับแก่ผู้ใช้ อย่างไรก็ตาม ข้อบังคับอื่นนอกจากข้อบังคับดังกล่าวยังมีผลใช้บังคับ
17.การแจ้งเตือนและการติดต่อ
17.1.สำหรับการแจ้งเตือนจาก Hihru ต่อผู้ใช้เกี่ยวกับบริการฯ Hihru อาจใช้วิธีการที่ Hihru เห็นว่าเหมาะสม เช่น การประกาศไว้ในระบบการให้บริการฯหรือเว็บไซต์ของ Hihru เอง
17.2.สำหรับการแจ้งเตือนจากผู้ใช้ต่อ Hihru เกี่ยวกับบริการฯ ผู้ใช้จะต้องใช้แบบฟอร์มสอบถามสำหรับลูกค้าที่อยู่ในระบบการให้บริการฯ หรือบนเว็บไซต์ซึ่ง Hihru เป็นผู้ดำเนินงานหรือโดยวิธีการอื่นๆ ที่ Hihru กำหนด
18.กฎหมายที่ใช้บังคับและเขตอำนาจศาล
ในกรณีที่ Hihru ได้จัดหาคำแปลฉบับภาษาไทยของข้อกำหนดและเงื่อนไขฯ ฉบับนี้ให้แก่ผู้ใช้ ("ฉบับภาษาไทย") ให้ฉบับภาษาไทยมีผลใช้บังคับในเรื่องความสัมพันธ์ระหว่างผู้ใช้และ Hihru ในกรณีที่มีการขัดกันระหว่างฉบับภาษาไทยและฉบับแปลอื่นเกิดขึ้นไม่ว่าในกรณีใด บทบัญญัติในฉบับภาษาไทยจะมีผลบังคับเหนือฉบับแปลอื่นใดทั้งสิ้น ทั้งนี้ ข้อกำหนดและเงื่อนไขฯ ฉบับนี้จะอยู่ภายใต้บังคับของกฎหมายไทย ความขัดแย้งที่เกิดขึ้นจากหรือมีความเกี่ยวพันกับการบริการฯ หรือความขัดแย้งระหว่างผู้ใช้และ Hihru ที่เกี่ยวกับบริการฯ จะถูกตัดสินและอยู่ภายใต้เขตอำนาจศาลประเทศไทย
